Terms of Service
These Terms of Service establish the terms and conditions for using the fashion item identification and information service (hereinafter referred to as the 'Service') provided by DECODED (hereinafter referred to as the 'Company'), and regulate the rights, obligations, and responsibilities between the Company and its members.
Article 1 (Purpose)
These Terms of Service aim to establish the terms and conditions for using the fashion item identification and information service provided by DECODED, and regulate the rights, obligations, and responsibilities between the Company and its members.
Article 2 (Definitions)
Service
Refers to the fashion item identification and information service that members can access through mobile devices.
Member
Refers to an individual who has agreed to these Terms of Service and entered into a service usage contract with the Company.
Content
Refers to all information, including images and text, that members upload to the Service.
Points
Refers to virtual data used within the Service for requesting item information and other purposes.
Posts
Refers to text, documents, pictures, photos, videos, etc. that members post on the Service.
Article 3 (Effectiveness and Modification of Terms)
These Terms are effective for all members who wish to use the Service.
The Company may revise these Terms within the scope that does not violate relevant laws such as the 'Act on the Regulation of Terms and Conditions' and the 'Act on Promotion of Information and Communications Network Utilization and Information Protection'.
When the Company revises the Terms, it will announce the effective date and reasons for revision along with the current Terms on the Service's notice board 7 days prior to the effective date. However, for revisions unfavorable to members, notice will be given 30 days in advance.
Members may request withdrawal if they do not agree to the revised Terms, and if they continue to use the Service after the effective date of the revised Terms, they will be deemed to have agreed to the revisions.
Article 4 (Service Content)
1. The Company provides the following services:
- Fashion item identification and information service
- Item information sharing community service
- Influencer/celebrity worn item information service
- Differentiated services based on member levels
- Other services determined by the Company
2. Service Changes
The Company may change the content of services to improve service quality, and in such cases, will notify the changes and their effective dates in advance.
Article 5 (Formation of Service Usage Contract)
1. Contract Formation
The service usage contract is formed when an individual wishing to become a member (hereinafter 'applicant') agrees to these Terms and applies for membership, and the Company accepts such application.
2. Grounds for Rejection
- When the applicant has previously lost membership under these Terms
- When using a false name or another person's name
- When providing false information or failing to provide required information
- When approval is impossible due to the applicant's fault or when applying in violation of other stipulated requirements
3. Reservation of Acceptance
The Company may reserve acceptance if there are technical or operational issues, or if service-related facilities are insufficient.
Article 6 (Management of Member Information)
1. Account Management
Members are responsible for managing their ID and password and must not allow third parties to use them.
2. Account Restrictions
The Company may restrict the use of IDs that risk personal information leakage, are antisocial, violate public morals, or could be mistaken for the Company or its operators.
3. Account Theft Report
Members must immediately notify the Company and follow the Company's guidance if they become aware that their ID and password have been stolen or are being used by a third party.
Article 7 (Member Obligations)
1. Prohibited Actions
- Registering false information during application or modification
- Stealing others' information
- Modifying information posted by the Company
- Transmitting or posting information other than that specified by the Company (including computer programs)
- Infringing on intellectual property rights of the Company and third parties
- Damaging the reputation of or interfering with the business of the Company and third parties
- Publishing or posting obscene or violent messages, images, sounds, or other information contrary to public order and morals
- Using the service for commercial purposes without the Company's consent
- Other illegal or improper actions
2. Other Obligations
Members must comply with relevant laws, these Terms, usage guidelines, posted precautions, and matters notified by the Company, and must not interfere with the Company's operations.
Article 8 (Service Provision and Changes)

- All other services provided to members through the Company's development or partnership agreements
2. Service Changes
The Company may change parts of the service without notice to improve service quality, and no separate compensation will be provided to members for such changes.
Article 9 (Point Policy)
1. Point Allocation
- Members can earn points through activities within the Service.
- Point-earning activities and amounts may be changed according to Company policy.
2. Point Usage
- Points can be used for requesting item information and other purposes within the Service.
- Point usage conditions and scope may be changed according to Company policy.
3. Point Expiration
- Points automatically expire upon membership withdrawal.
- The Company may set validity periods for points, and points will expire after their validity period.
4. Point Refunds
- Points cannot be refunded for cash.
- Compensation may be provided according to Company policy in cases of service termination or other Company liability.
Article 10 (Copyright Attribution and Usage Restrictions)
1. Copyright Attribution
Copyrights and other intellectual property rights for works created by the Company belong to the Company.
2. Usage Restrictions
Members may not use or allow others to use information to which the Company holds intellectual property rights for commercial purposes without prior consent from the Company, including reproduction, transmission, publication, distribution, or broadcasting.
3. Post Copyright
Copyright for posts published by members within the Service belongs to their respective authors.
4. Content Utilization
Posts published by members may appear in search results, services, and related promotions, and may be partially modified, reproduced, or edited as necessary for such exposure.
5. Content Suspension
The Company may temporarily suspend content upon receiving takedown requests for copyright infringement, and may restrict access to such content until resolution through litigation or settlement between the requesting party and the poster.
Article 11 (Image Copyright and Usage)
1. Image Upload Principles
- Members may only upload images for which they hold copyright or have received permission to use.
- All images must clearly indicate their source.
- Images with unknown sources must be marked as 'Source Unknown' and must be removed immediately upon copyright holder's request.
2. Permitted Images
- Images taken by the member
- Captures from public SNS posts (source must be credited)
- Official press release images (source must be credited)
- Images with explicit permission from copyright holders
3. Restricted Images
- Commercial photoshoot or magazine scan images
- Images with watermarks
- Paid content images
- Images violating others' portrait rights
- Images violating others' copyrights
4. Copyright Infringement Liability
- Members are solely responsible for copyright-related issues of their uploaded content.
- Members guarantee that their uploaded content does not infringe on third-party copyrights.
- Members bear all responsibility for disputes and damages arising from copyright infringement.
- The Company bears no responsibility for members' copyright infringement.
Article 12 (AI Technology and Data Usage)
1. AI Learning Data Usage
- Images uploaded by members may be used as training data for AI models.
- Personal identification information is excluded from AI training.
- Trained data is used only for service quality improvement purposes.
2. Data Provision and Usage Scope
- Data provided by members may be used for service improvement and new service development.
- When necessary for statistical compilation, academic research, or market research, data may be processed in a form that cannot identify specific individuals.
Article 13 (Service Usage Restrictions)
1. Grounds for Restriction
- Repeated copyright infringement
- Violation of portrait rights
- Repeated posting of false information
- Posting commercial advertisements without consent
- Interfering with other members' service usage
- Deliberately interfering with service operations
- Violating relevant laws or the Company's terms of service
2. Stages of Service Restrictions
- First violation: Warning and content removal
- Second violation: 7-day service restriction
- Third violation: 30-day service restriction
- Fourth violation: Permanent service restriction
Article 14 (Compensation for Damages)
1. Copyright Infringement Compensation
- Members are liable for all damages arising from copyright infringement of content they upload to the Service.
- If the Company receives damage claims or lawsuits from third parties due to a member's copyright infringement, the member shall defend and indemnify the Company at their own expense.
- Members must compensate for all damages incurred by the Company related to copyright infringement (including legal fees and settlement costs).
2. General Compensation
If the Company suffers damages due to a member's violation of these Terms, the member shall be liable for all such damages.
3. Third-Party Claims
If the Company receives claims or lawsuits from third parties due to a member's illegal actions or violations of these Terms, the member shall indemnify the Company at their own expense, and if indemnification is not possible, the member shall compensate for all resulting damages.
Article 15 (Disclaimer)
1. Force Majeure
The Company is exempt from responsibility for service provision when unable to provide services due to force majeure such as natural disasters, war, telecommunications service suspension, or other similar circumstances.
2. Member Liability
The Company is not responsible for service disruptions caused by member fault.
3. Loss Disclaimer
The Company is not responsible for lost profits expected by members through service use, nor for damages caused by materials obtained through the service.
4. Content Disclaimer
The Company is not responsible for the reliability, accuracy, or other aspects of information, materials, and facts posted by members.
Article 16 (Dispute Resolution)
1. Complaint Handling
The Company shall prioritize handling complaints and opinions submitted by members. However, when prompt handling is difficult, the Company shall immediately notify members of the reason and processing schedule.
2. Dispute Mediation
In case of e-commerce disputes between the Company and members, the parties may follow mediation by dispute resolution bodies designated by the Fair Trade Commission or provincial governors upon member request for damage relief.
